Service Provider: Studio Kreacja Przemysław Bazanowski, ul. Artura Grottgera 15/11, 63-100 Śrem, Poland, NIP (tax ID) 7851746559, e-mail: office@socialu.ai, website: https://socialu.ai
§ 1. Definitions and scope
These Terms set out the rules for the electronic provision of the services of the Socialu.ai Platform by the Service Provider to Customers who are businesses or consumers.
- Platform – the Socialu.ai SaaS application;
- Account – an individual User's access;
- Customer – the party to the Agreement;
- Brand – a brand profile managed in the Platform;
- Plan – a subscription variant;
- AI Credits – billing units for AI operations;
- Autopilot – a feature that automatically prepares or publishes content within the Customer's settings.
§ 2. Contact and technical requirements
Contact: office@socialu.ai. Use requires internet access, an up-to-date browser, an active e-mail address and — for integrations — permissions to the relevant external accounts.
The Customer undertakes to protect login credentials, apply appropriate permissions and not share the Account with unauthorised persons.
§ 3. Account and conclusion of the Agreement
The Agreement is concluded upon registration and acceptance of the Terms; a paid Plan is activated on the conditions presented before purchase. Information on the price, billing period, renewal and benefits must be provided before the order is placed.
The Customer provides true data and keeps it up to date. The Customer is responsible for the actions of persons admitted to the Account in accordance with the law and the permissions granted to them.
§ 4. Scope of services
The Platform may provide generation of texts, graphics and video, scheduling and publishing of posts, analytics, advertising campaigns, CRM and lead handling, landing pages, forms, funnels, e-mail communication, web push, chatbots, bookings, recordings and transcriptions. The availability of individual modules depends on the Plan, configuration and stage of rollout.
Integrations with Meta, Google, LinkedIn, TikTok and other services are also subject to the terms of their providers. The Service Provider does not guarantee uninterrupted operation of external APIs or any particular reach, number of leads or sales.
§ 5. Autopilot and automated actions
Autopilot requires deliberate activation by the Customer. The Customer determines the scope of authorisation, available channels and automation settings and may restrict or disable the feature.
The Customer should supervise published content and automated actions. Before launching actions that incur advertising spend, the Platform should present the relevant budget settings and scope of authorisation.
§ 6. Content and artificial intelligence
AI outputs may contain errors, inaccuracies or content similar to outputs obtained by other persons. The Customer should verify their lawfulness, accuracy and third-party rights and appropriately label materials generated or modified by AI where required by law.
The Customer may not use the Platform to infringe copyright, personal rights or data protection laws, to send spam, commit fraud or circumvent the security of external services.
§ 7. Rights to materials
The Customer retains the rights to materials it lawfully enters into the Platform. It grants the Service Provider a non-exclusive authorisation to technically store, process, copy and transfer them to selected providers solely for the purpose of performing the Agreement.
Rights to AI outputs are determined by law and by the terms of the relevant providers; the Service Provider does not guarantee that copyright arises in every output.
§ 8. Recordings, contact data and marketing
If the Customer records conversations or statements of its clients, the Customer alone is responsible for establishing the appropriate legal basis, fulfilling information obligations and obtaining the required rights to image and voice.
The Customer is responsible for the lawfulness of obtaining contacts, the legal basis for sending marketing communications, handling unsubscribes and the content of campaigns. Importing data into the CRM does not in itself constitute consent to marketing.
§ 9. Plans, payments and renewals
Paid Plans are billed according to the price list presented during the purchase process. The subscription renews automatically for the next period unless cancelled before renewal, in accordance with the information provided at purchase.
Cancellation turns off the next renewal; access to paid features continues until the end of the current billing period. The absence of a voluntary pro-rata refund for the unused part of the period does not limit the statutory rights of consumers.
Payments are handled by Stripe and Przelewy24. Accounting documents are issued in accordance with the law.
§ 10. AI Credits
AI Credits granted under a subscription expire at the end of the given billing period and do not carry over to the next period. Additionally purchased AI Credits are recorded separately and do not expire as long as the Account is maintained.
Detailed rules on charging, order of consumption, settlement of failed operations and Account closure are set out in a separate document, "AI Credits and Subscription Billing Rules".
§ 11. Complaints and conformity of the service with the contract
Complaints may be sent to office@socialu.ai, describing the problem, the Account and the expected resolution. The Service Provider responds within the time limits required by law, in particular in consumer relationships.
Consumers have statutory rights in the event of a lack of conformity of the digital service with the contract; no provision of the Terms limits them.
§ 12. Consumer withdrawal
As a rule, a consumer has 14 days to withdraw from a distance contract, subject to statutory exceptions. Where performance began at the consumer's express request, the effects of withdrawal and any settlement are assessed in accordance with the Polish Consumer Rights Act.
The model statement is a separate document ("Model Withdrawal Form"). Statutory exceptions to the right of withdrawal require the relevant conditions to be met and are not presumed from mere acceptance of the Terms.
§ 13. Suspension, security and liability
In the event of a reasonable suspicion of a breach of law or security, the Service Provider may apply proportionate access restrictions, informing of the reason and the possibility of appeal where required by law.
Liability towards consumers is determined by mandatory provisions of law. In B2B relationships, liability may be subject to limitations arising from an individually accepted agreement; this does not cover damage whose liability cannot be limited.
§ 14. Data, export and termination
The Customer may use the export of Account, Brand or Company data as a ZIP with JSON, as well as the relevant exports of individual resources. Media export in the standard archive has a technical limit of 200 MB; where needed to fulfil statutory obligations, the Customer may request another method of data transfer.
After deletion of the Account, active data is deleted without undue delay, within 14 days at most, and backups are rotated within 30 days at most, with exceptions provided by law. The separate retention rules ("Data Retention, Export and Deletion Policy") and the DPA ("Data Processing Agreement") apply.
§ 15. Changes and governing law
Changes to the Terms require a valid reason and notice to the Customer with appropriate advance notice, in accordance with the rules on digital services. This does not limit the consumer's right to terminate the agreement in the cases provided by law.
Polish law applies, without depriving consumers of the protection afforded to them by the mandatory provisions of the law of their habitual residence.
YouTube integration
By using YouTube features in the Platform, the Customer agrees to be bound by the YouTube Terms of Service; Google also processes data under the Google Privacy Policy.
